1 <p>LogMeal as a brand of AIGECKO TECHNOLOGIES S.L. (hereinafter referred to as “AIGECKO”) takes personal privacy very seriously, including that of anyone visiting our website www.logmeal.com (hereinafter referred to as the “Website”), or anyone supplying information through the Website (hereinafter referred to as “you” or the “user” or in plural, the “users”).</p>

2 <p>With this in mind, AIGECKO is committed to processing your data in accordance with current and applicable data protection legislation. In particular, AIGECKO will meet the principles pursuant to Organic Law 3/2018, of 5 December, on Personal Data Protection and Securing Digital Rights, as well as those under Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC and any other implementing regulations in force at a given time.</p>

3 <p>This Privacy Policy applies exclusively to data collected through communication channels on the Website (including, but not limited to, emails and phone numbers). We therefore urge all users to carefully read this Privacy Policy in order to learn about how any of their data collected through the communication channels on the Website will be processed. We also ask all users to read the General Principles on personal data protection which applies to all AIGECKO Group companies/brands.</p>

10 <p>As part of providing our services via the LogMeal App and the LogMeal API, we may collect and process the following personal data from end-users. The type and scope of data collected depend on the login method used and user activity within the app.</p>

12 <h2>1.2 Legal basis for processing personal data</h2>

13 <p>The processing of personal data collected through the LogMeal App or API is carried out in accordance with Article 6 of the General Data Protection Regulation (GDPR). Each category of data is processed based on one or more of the following legal grounds:</p>

15 <h2>2. What are the purposes of processing your data?</h2>

16 <p>AIGECKO collects and processes your personal data using emails sent and/or calls received in order to meet and manage any requests, questions, and/or enquiries sent. In short, to serve you as requested.</p>

17 <p>Furthermore, any time you send your CV or professional information to the specifically dedicated email address on the Website ( rrhh@aigecko.com ), we will process your data in order to manage any CV’s and information sent by candidates for current and/or future recruitment processes.</p>

18 <h2>3. What are the legitimate grounds for processing your data?</h2>

19 <p>A precontractual and/or contractual relationship, if appropriate, plus the legitimate interest of AIGECKO are the legal bases for meeting and managing any requests, questions, and/or enquiries sent. With regard to personal data processing when managing your application for AIGECKO recruitment processes, the legal basis is you granting your consent by sending us your CV and personal information to the dedicated email address. In other words, the act of sending us said information represents a clear affirmative action for processing your personal data and considering you as a potential candidate.</p>

20 <h2>4. How long do we store your data?</h2>

21 <p>AIGECKO will process your personal data for as long as needed to meet the purposes set out in this Privacy Policy, and this also includes storing your personal information to comply with the provisions of relevant legislation, especially with regard to limitation periods laid down in law, and for establishing, exercising or defending legal claims.</p>

22 <p>Our criteria for this is determined by: (a) the purpose of the data collected and meeting said purpose; (b) the reasons why the data is collected: i.e., if consent is provided, you can withdraw it at any time, and (c) mandatory storage periods under contractual and regulatory requirements.</p>

23 <p>Keep in mind that there are some situations where AIGECKO may store your data for the time required to establish, exercise, or defend legal claims, requirements, responsibilities, and legal, contractual or ethical obligations, and your data will always be properly blocked.</p>

24 <h2>5. To whom may we disclose your data?</h2>

25 <p>Please note your personal data will never be disclosed to third parties without your explicit consent. However, as a result of your relationship with us we may disclose your data to: (1) companies belonging to the AIGECKO Group at any given time; (2) other law firms and/or professionals we may work with, as long as you have provided your consent for us to do so; (3) competent bodies and/or authorities for cases where a legal requirement and/or obligation exists.</p>

26 <h2>5.1 Where is your data processed and stored?</h2>

27 <p>The vast majority of user data collected by the LogMeal App and API is stored and processed within the European Union (EU). Our primary infrastructure is hosted on Google Cloud Platform (GCP), with servers located in EU regions, and we take appropriate steps to ensure data sovereignty and regulatory compliance.</p>

28 <p>By default, all user data is stored in databases located in the EU. However, under certain custom service plans or at the explicit request of a client, we may replicate or relocate databases to other global regions. Our infrastructure is designed to support secure, region-specific deployments to meet the needs of our clients around the world.</p>

29 <p>If data is ever transferred outside the EU, we ensure that appropriate safeguards are in place, including the use of Standard Contractual Clauses (SCCs) or equivalent protection mechanisms in accordance with Articles 44-49 of the GDPR.</p>

30 <h2>6. Who has access to your personal data?</h2>

31 <p>Depending on the purposes why your personal data is being collected, any of the following people may access them individually: (a) AIGECKO Group authorized staff or their representatives acting on behalf of the AIGECKO Group, subject to any applicable data protection legislation; (b) regulatory authorities and other third parties in compliance with applicable legislation; (c) third parties/data processers (service providers processing information as data processors under the instructions of AIGECKO). All of this will only take place after undertaking the actions necessary to ensure that we may share said information and after entering into the relevant external data processor contract in compliance with data protection regulations.</p>

32 <h2>7. What are your rights when you provide us with your data?</h2>

33 <p>Users may request the following rights:</p>

34 <ul><li>Right to request access to personal data: you may ask AIGECKO if it is processing your data, and if so, access them.</li>

35 <li>Right to request rectification if there are any data inaccuracies, or fill in any incomplete data we have.</li>

36 <li>Right to request data erasure.</li>

37 <li>Right to request restriction of processing: in this event we would only store them for exercising or defending legal claims.</li>

38 <li>Right to object to processing: AIGECKO will stop processing personal data, except when necessary for legitimate reasons or for exercising or defending possible legal claims.</li>

39 <li>Right to data portability: should a user wish to have their data processed by a different controller, AIGECKO will transmit their data to the new controller.</li>

40 <li>Right to not be subject to a decision based solely on automated processing.</li>

41 </ul><p>If you granted your consent for a specific purpose you may withdraw it at any time. Withdrawing consent will not affect the lawfulness of processing based on consent before its withdrawal.</p>

When there are doubts regarding your identity, you may be asked to provide a photocopy of your DNI or of any other valid identity document. 43 <p>Please note that you have the right to lodge a complaint with the supervisory authority, in this case the Spanish Data Protection Agency (<a>https://sedeagpd.gob.es/sede-electronica- web/vistas/formNuevaReclamacion/reclamacion.jsf</a>), and with other public competent bodies for any complaints regarding your personal data.</p>

44 <h2>8. How can you delete your user data?</h2>

45 <p>User account deletion. As an end-user of the LogMeal App, you may refuse to use your user profile and might want to get an end-user account deleted. In that case, you may ask us to delete your account in the Profile settings. If you choose to do so, your account will be inactivated and the data will be lost.</p>

46 <p>As a company you might want to get an end-user account deleted. In this case, you may use either the removal button present in your Profile or the available endpoint present in the API documentation.</p>

47 <p>Please note that if you have requested your account to be deleted, we will delete the subsequent personal data you have supplied us. However some data, such as restaurant-specific transactions or images, will be saved as they have already integrated into our system. This data must be stored to maintain the integrity of the platform, as well as for legitimate business processes, including audits and security purposes.</p>

48 <p>Data retention. We will keep your personal data (1) until you decide to delete your account (upon request), or (2) as required by law or as necessary for legitimate business purposes (i.e. for tax, legal, accounting, fraud, or abuse prevention, and/or other purposes). This data can be stored even after an account is deleted.</p>

49 <p>Upon account deletion, we will securely destroy your personal data in accordance with applicable laws and regulations. In some circumstances we may anonymize your personal data so that it can no longer be associated with you. In this case, such data is no longer considered personal.</p>

50 <h2>9. How do we protect your personal data?</h2>

51 <p>In order to ensure information is secure, AIGECKO uses various technical and organizational measures to guarantee the appropriate level of security in accordance with the applicable regulations. In any case, AIGECKO will implement appropriate technical and organizational measures when designing the data processing system and when actually processing in order to safeguard security and prevent unauthorized processing. Despite these measures being implemented efficiently, users are cautioned that Internet security measures are not impenetrable. AIGECKO is not liable for the acts of third parties who gain access to said data and information by violating these measures.</p>

52 <h2>10. Confidentiality</h2>

53 <p>AIGECKO professionals involved in the provision of services to the user are committed to not disclosing or using any information they have accessed. Any information provided by the user will be confidential at all times, and will not be used for any purposes outside of those related to managing the requests and services they ask from AIGECKO, if appropriate. In this sense, we are committed to not disclosing or revealing information about the user’s intentions, the reasons behind the advice requested, or how long they have been advised for.</p>

54 <h2>11. Social networks</h2>

55 <p>AIGECKO is active on some of the main social networks online, and for which it acts as the data controller processing the information AIGECKO posts.</p>

56 <p>AIGECKO will process data on each social network in accordance with the rules that each social network has laid down. Unless otherwise stated, at AIGECKO we may let our followers on each social network know about our activities, events, and other related issues, which also includes follower service, using the channels social networks provide for this purpose.</p>

57 <p>AIGECKO will not retrieve personal data from social networks, unless users give us their explicit consent to do so.</p>

59 <p>This Website may contain links to other websites. Please be aware that we are not responsible for the privacy and data processing employed by other websites. This Privacy Policy applies solely to the information collected on the Website. We recommend reading the privacy and data processing policies of the websites linked on our Website or of the ones you visit anyways.</p>

60 <h2>13. The integrity of our Privacy Policy and amending it</h2>

61 <p>We will only use your personal data as set forth in the Privacy Policy existing at the time your personal data was collected. AIGECKO reserves the right to amend this Privacy Policy at any time. We will post these changes on our Website, so we recommend you check our Privacy Policy every time you visit it. If at any time we decide to use your personal data in a way different from that stated at the time it was collected, we will notify you via email (provided that we have your email address). At that time, you will be given the option to allow that the personal data you provided us before our Privacy Policy was amended be used and disclosed in other manners.</p>

62 <p>If any of this Privacy Policy’s clauses is held to be invalid or unenforceable, the remaining terms and conditions will remain in effect, and they shall continue to be valid and enforceable pursuant to current implementing regulations.</p>

In this sense, we do not intentionally collect information from said individuals. 65 <li>Special category of personal data. We will not collect or process any particularly sensitive data or data included in the special category for users’ personal data, unless they have specifically provided us with them.</li>

66 <li>Automated decision-making. We will not use automated decision- making, which includes profiling, unless we have been specifically authorized to do so. In that case, we would let you know about the logic used in the decision, and about the meaning and expected consequences of said processing for you.</li>

67 <li>Updating data. It is crucial that the personal data we have from you be up-to-date and accurate. We therefore ask that you inform us of any changes in your personal data as soon as possible. This way AIGECKO’s information is always up-to-date and accurate.</li>
