The Fair Credit Reporting Act (FCRA) is the primary federal law regulating how background screening companies—legally known as Consumer Reporting Agencies (CRAs)—collect, verify, maintain, and deliver consumer information for employment purposes. It ensures the accuracy, fairness, and privacy of information in consumer reports used for hiring, promotion, retention, and other employment decisions.
Q: What is a “Consumer Report”?
A “Consumer Report” under the Fair Credit Reporting Act (FCRA) is any written, oral, or electronic communication from a Consumer Reporting Agency (CRA) that contains information about a person’s creditworthiness, credit standing, credit capacity, character, general reputation, personal characteristics, or mode of living, and is used (or expected to be used) for decisions about employment, credit, insurance, housing, or other permissible purposes.
Q: What is Adverse Action?
Under the Fair Credit Reporting Act (FCRA), adverse action is any negative decision made about a consumer based in whole or in part on information in a consumer report, including background checks.
In employment, this typically means:
• Denying a job offer
This applies only when the decision is based on information from a third party background screening company (a CRA). If the employer finds the information directly (e.g., through their own verification), FCRA adverse action rules do not apply.
Q: What is a “Dispute?”
A dispute is when a consumer formally notifies a Consumer Reporting Agency (CRA) or a furnisher (the source of the data) that information in their consumer report—including a background check—is inaccurate, incomplete, or not verifiable.
Q: My identity was stolen, I am a victim, what do I do?
If you believe you are the victim of identity theft, you should contact the credit bureau(s) for information on how to place a fraud alert or file block on your consumer credit file. For U.S.-based candidates, additional information on identity fraud may be found on the Federal Trade Commission’s Identity Theft Data Clearinghouse Web site at www.consumer.gov/idtheft.
Q: If I have a criminal record that was dismissed, can I still get a job?
Universal Background Screening is not involved in the hiring process and does not evaluate the information returned on your report. Please contact the company or organization you applied to for information about how it uses the information returned on your report.
Q: How long does a background check take?
Most background checks are completed within 3–5 business days. Some searches may take longer depending on court availability, verifier response times, or local delays. If any part of your background check requires additional time, it will update automatically in your portal as soon as results are received.
Q: What do I need to bring to a drug test/health screen?
For a drug test, you are required to bring your driver’s license or legal ID and your “Donor Pass”. Your donor pass is stored electronically within your Universal Background Screening and in your Email. We recommend prior scheduling and arriving early for the best experience. You can call the clinic to schedule or make an appointment online at some clinics.
Q: What if I have a prescription for one of the medications they test for?
A medical review officer will contact you to verify your prescription information after you provide your sample. Just be sure to connect with them and your results will be changed to negative, so you’ll be all set.
Q: How long does a drug test result take?
Drug test results usually come back within 3–5 days if the result is negative.
If the result is positive, additional confirmation testing by the Medical Review Officer (MRO) is required, which can take up to 2 weeks.
If you have a prescription for the medication detected, the MRO will contact you to verify it.
Please make sure to answer their calls or have enough voicemail space. If you miss their call, return it as soon as possible so they can finalize your results correctly. Their contact information is listed on your MRO report.
Q: Can I resubmit or update my information? How do I submit information or documents to Universal Background Screening?

Q: The records on my report aren't mine or are inaccurate
If your background check report contains information you believe to be inaccurate, you can file a dispute. Examples of disputes include the ones below:
A record reported doesn’t belong to you.
A record has incorrect details, such as dates or charge type.
A case status changed after the record was reported.

Reinvestigation process
Review and verification: During a reinvestigation, Universal Background Screening reviews and verifies the contested information.
Timeframe: In compliance with the Fair Credit Reporting Act (FCRA), Universal Background Screening has 30 days to complete a reinvestigation. However, Universal Background Screening strives to complete reinvestigations as quickly as possible.
Notification of results
Email notification: After the reinvestigation, Universal Background Screening emails you with the results.
Updated report: If the reinvestigation results in changes to your background check report, it will be updated, and you’ll receive a copy of the updated report.
Hiring company or organization notification
Hiring company or organization notification: The company or organization you applied to also receives notification that the dispute is complete.
Review changes: The company or organization can review any changes before making a hiring or engagement decision.
Q: What is an MRO?
A Medical Review Officer (MRO) is a licensed physician who is specially trained to review drug test results. Their job is to:
Confirm positive test results by ensuring the lab findings are accurate
Contact the candidate to verify whether there is a valid medical explanation (such as a prescription)
Protect candidate privacy by handling sensitive medical information
Ensure employers receive accurate, legally compliant results
In short, the MRO makes sure drug test results are fair, accurate, and medically reviewed before they are reported.
Q: What will companies do with the information on my report?
Universal Background Screening isn’t involved in the hiring process and doesn’t evaluate the information returned on your report. Please contact the company or organization you applied to with questions about how it uses the information returned on your report.

Your donor pass is stored electronically within your Universal Background Screening and in your Email. We recommend prior scheduling and arriving early for the best experience. You can call the clinic to schedule or make an appointment online at some clinics. </p>

Just be sure to connect with them and your results will be changed to negative, so you’ll be all set.</p>

If the result is positive, additional confirmation testing by the Medical Review Officer (MRO) is required, which can take up to 2 weeks.<br />
If you have a prescription for the medication detected, the MRO will contact you to verify it.<br />
Please make sure to answer their calls or have enough voicemail space. If you miss their call, return it as soon as possible so they can finalize your results correctly. Their contact information is listed on your MRO report.</p>

Notification of results<br />
Email notification: After the reinvestigation, Universal Background Screening emails you with the results.<br />
Updated report: If the reinvestigation results in changes to your background check report, it will be updated, and you’ll receive a copy of the updated report.<br />
Hiring company or organization notification<br />
